A non-medical agency may not use the terms 'home health agency' or 'home health services' without a ch. 23-17.3 licence (33-03-10.1-03). QSP service definitions include homemaker services: meal preparation, shopping, bill paying, housework, laundry, transportation, communication and mobility outside the residence.

The skilled door in North Dakota

Home Health Agency licensure under N.D.C.C. ch. 23-17.3 requires the agency to provide skilled nursing and at least one other therapeutic service (PT, OT, speech, medical social services or home health aide services) on a regular basis (§23-17.3-05(1)(a)), with plans of treatment, personnel folders and full ownership disclosure. Initial licence is for no more than 1 year, expiring 31 December; provisional licence max 90 days, renewable once.

Gate on record: Moratorium

Check before enrolment: the HHS QSP page carries a standing 'Provider Enrollment Moratoria' notice/link. Any active moratorium by service/county would pause new QSP enrolment for that service; the page retrieved lists the moratoria resource but no service-specific moratorium text was extracted in this pass, so verify current moratoria in the QSP portal at enrolment.

Medicaid in North Dakota: a second gate

This is the main regulated door for non-medical care in North Dakota: enrol as an Agency Qualified Service Provider (QSP) with ND Health and Human Services to deliver Medicaid State Plan Personal Care (MSP-PC) and HCBS waiver services. Clients choose among enrolled QSPs; QSPs are independent contractors meeting competency standards, bill through ND Health Enterprise MMIS, and use the QSP Hub (University of North Dakota Center for Rural Health) for enrolment support. Family Personal Care and Family Home Care are related individual-QSP enrolments for relatives living with the client.

EVV is a core QSP duty: HHS/QSP Hub training covers electronic visit verification (Therap is the documentation/EVV system referenced in QSP trainings), service authorisation and billing. Federal Cures Act EVV applies to Medicaid personal care in any event.
