| License / registration | Registration of home care agencies with OHFLAC (W. Va. Code §15-2C-7) for non-medical providers not otherwise licensed — no licence name for non-medical home care; skilled lane: Home Health Agency licence |
| Issued by | West Virginia Office of Health Facility Licensure and Certification (OHFLAC), Department of Health / Office of Inspector General; Certificate of Need: West Virginia Health Care Authority — official page |
| Application / initial fee | $0 — §15-2C-7(a) is explicit: all home care service providers not currently licensed, certified or registered shall register with OHFLAC and 'No fee may be charged for registration.' Registration requires name/address/phone, geographic area, number of homes and consumers, and services provided (e.g. nursing care or personal assistance), signed on the registration form. This is registration to access the central abuse registry, not an operating licence. |
| Renewal | No renewal fee published for the §15-2C-7 registration. Skilled home health licensure fees are in the OHFLAC licensure rules for the facility type and were not published as a single home-health figure in the sources reviewed — do not confuse with hospital/SSP fees on the OHFLAC site. |
| Surety bond | No state bond minimum found in the published rules |
| Liability insurance | State sets no minimum for registered non-medical providers in §15-2C-7. |
| Timeline | Not published for registration. For CON-reviewable projects, licensure applications in analogous OHFLAC rules must be filed at least 90 days before proposed commencement, and no initial licence may issue until the Health Care Authority has made a final conformance finding against the CON decision. |
| Administrator | No administrator qualification is imposed by the §15-2C-7 registration itself. Medicaid Personal Care / Aged and Disabled Waiver agencies must instead meet Bureau for Medical Services provider certification, staffing and training standards, which are separate from OHFLAC registration. |
| State extras | Fingerprint-based background checks through the WV Criminal Identification Bureau / FBI and central abuse registry checks for caregivers; BMS certification costs if pursuing Medicaid work. CON fees ($1,500-$35,000 by project cost) apply only to the skilled/CON lane. |
| Service | Under this license |
|---|---|
| Companionship & supervision | Covered |
| Homemaker help | Covered |
| Hands-on personal care | Covered |
| Live-in / 24-hour care | Not covered by this license |
| Transportation | Not covered by this license |
| Skilled nursing or therapy | Home health license + a gate (see below) |
Registration does not authorise skilled care. A provider that is otherwise required to be licensed (home health) cannot use §15-2C-7 registration as a substitute for licensure, and a licence for a CON-reviewable project cannot issue without CON conformance.
Home health agencies are licensed by OHFLAC and are CON-reviewable under W. Va. Code §16-2D: W. Va. Code §16-2D-8(a)(11) ties home health expansion to CON, and OHFLAC licensure rules bar an initial licence for a §16-2D-reviewable project until the authority finds the project conforms to the CON decision. CON application fees under §16-2D-13 are tiered by project cost: $1,500 (up to $1.5M), $5,000 ($1.5M-$5M), $25,000 ($5M-$25M), $35,000 (over $25M), with a letter of intent 10 days before filing.
Skilled lane only: Certificate of Need under W. Va. Code Ch. 16-2D is required before establishing/expanding home health services; CON is administered by the West Virginia Health Care Authority, requires determination of need, consistency with the State Health Plan and financial feasibility, and licensure cannot issue until final CON conformance. Non-medical registration under §15-2C-7 has no CON gate.
Bureau for Medical Services (BMS) certification/enrolment as a Personal Care agency or Aged and Disabled Waiver (ADW) provider after OHFLAC registration; ADW also offers the self-directed Personal Options model, with Palco as Financial Management Services vendor since 1 Feb 2024, where the member hires the worker directly.
EVV required for Medicaid personal care / home health visits under the federal Cures Act (West Virginia open-vendor model in national EVV listings); registration alone does not make a provider Medicaid-payable.
The state fee above is one line of the real total. Run the true-cost calculator with West Virginia selected — it adds the bond premium, insurance class, screening and the payroll runway your first hires create.
This page is information, not legal advice. Confirm before you file: the agency — not this page — decides your application.
The free checkers give you the verdict and the number. The Kit gives you the working papers: your state's application packet walked through in filing order, the policies-and-procedures binder spec (what your binder must contain — never a boilerplate binder), the administrator self-audit, the insurance & bond spec sheet, the Medicaid gate map, the franchise-vs-independent 10-year worksheets, and the payroll-runway planner.
